Abstract

The rapid proliferation of online platforms has transformed user-generated content into a cornerstone of digital communication, raising critical questions about platform liability and its implications for freedom of expression. This study examines the European Union's E-Commerce Directive (2000/31/EC), which establishes a liability regime for intermediaries, offering safe harbors for hosting providers that act expeditiously to remove illegal content upon notice. By analyzing the Directive's Articles 12-15, the research explores how this framework shields platforms from proactive monitoring obligations, thereby fostering an open internet while mitigating risks of over-censorship. However, evolving challenges, such as the rise of disinformation, hate speech, and algorithmic amplification, have prompted scrutiny of its adequacy in balancing accountability with expressive rights. Drawing on case law from the Court of Justice of the EU, including landmark decisions like Google France and L'Oréal v. eBay, the article assesses the Directive's impact on online discourse, highlighting tensions with fundamental rights under the EU Charter. It argues for targeted reforms to enhance transparency and user protections without unduly restricting speech. Ultimately, the study underscores the Directive's enduring role in shaping global standards for digital governance, advocating for adaptive policies in an era of platform dominance.
